BOARD OF SELECTMEN
Minutes
July 31, 1996

Board met in Regular Session 7.30 p.m. in their Meeting Room in Abbot Hall

Present (constituting a quorum):

Motion made and seconded to appoint William E. Conly Chairman pro tem. All in favor.


TRAFFIC & SAFETY. Motion made and second to refer letter signed by William Finn requesting a handicapped parking space in front of 20 Mechanic Street to the Traffic & Safety Committee. All in favor.

PERMISSION. Fort Sewall. Motion made and seconded to approve the request of Geeraldine M. Hall and Douglas H. Rice to use Fort Sewall for their wedding ceremony on September 14, 1996 from 11:00 a.m. to 12:00 p.m. All in favor.

Devereaux Beach. Motion made and seconded to approve the request of David LeBlanc of the Greater Lynn Sportfisherman Association to use Devereaux Beach for a memorial striped bass fishing tournament from 6 to 10 p.m. on August 10, 1996. All in favor.

LICENSE. Common Victualler. Rinaldo's. Attorney Paul Yasi. representing Rinaldo's and James Lamont, Manager, d/b/a Rinaldo's Restaurant Co., Inc. appeared before the Board to request a Common Victualler License to operate a restaurant at Village Plaza. Hours are to be from 4 p.m. to 12 midnight. Would like to open by September first. Seating will not vary more than 5 or 6 seats from the previous owner's seating. Motion made and seconded for approval of the Common Victualler License. On a polled vote, the Board voted as follows: Mr. Purdin, in favor; Mrs. St. Laurent, in favor; Mr. Cutting, in favor; Mr. Conly, in favor.

All Alcoholic Beverage. Attorney Paul Yasi and Mr. James Lamont, Manager, appeared to request a transfer of the Annual All Alcoholic Beverage License as a Common Victualler from John Desmond, Chapter 7 Trustee in re Rinaldo's, Inc. U. S. Bankruptcy Court #96-11986-CJK and Rockett Management Co., Inc. to Rinaldo's Restaurant Co., Inc. Miroslaw Kantorosinski is President and Clerk of Rinaldo's, Inc. Employees will be TIPS Certified, and Mr. Conly requested copies of such certificates be sent to the Board of Selectmen. Motion made and seconded for approval. On a polled vote, the Board voted as follows: Mr. Purdin, in favor; Mrs. St. Laurent, in favor; Mr. Cutting, in favor; and Mr. Conly, in favor.

ADVISORY COMMITTEE ON DISABILITIES. Ed Lang, Joanne Shutz and Susan Ball appeared before the Board requesting they be recognized as an official committee by the Board of Selectmen as it relates to voluntary compliance for handicapped access as it pertains to municipal business. Town Administrator Sasso will meet with Mr. Lang, Mrs. Shutz and Mrs. Ball in the next few weeks and report back to the Board.

TRAFFIC & SAFETY. Motion made and seconded to post NO PARKING HERE TO CORNER, TOW ZONE, on Cowell Street, beginning at its intersect with Elm Street and running a distance of forty-five feet in a westerly direction along the southerly side for a thirty-day trial period. All in favor.

Motion made and seconded to notify Police to monitor parking on Hawkes Street at the Atlantic Avenue intersection. All in favor. Motion made and seconded that the Town Engineer investigate where the Town land is at the intersection of Hawkes Street and Atlantic Avenue going up towards Roundy's Hill.

Motion made and seconded to ask the Police Department to monitor traffic early evenings and week-ends on Commercial Street and report back to the Board next week as to the results. All in favor.

CABLE TV ADVISORY COMMITTEE. Paul Rabin, Chairman of this Committee, appeared before the Board with an update on the Continental Cablevision/U. S. West merger. Motion made and seconded to approve the Transfer of Control of the Marblehead cable television license from Continental Cablevision of Massachusetts, Inc., which is a wholly-owned subisidary of Continental Cablevision. Inc., to U. S. West, Inc. All in favor.

SALEM SOUND 2000. Selectman St. Laurent announced an application for a $20,000 grant from Coastal Zone Management to study the water shed at Wyman Cove. Motion made and seconded to authorize submittal and support for this application. All in favor.

E-911. Motion made and seconded to issue a Notice to Proceed and to authorize the Chairman to sign the contract between the Town and A&M Roofing for the construction ofthe E-911 Communication Center and Police Station Addition and Renovations subject to the review of Town Counsel. All in favor.

Recreation and Park/COA Building and E-9ll. Motion made and seconded to appoint Bob Gauthier as Clerk of the Works for both of these projects. All in favor.

CONSERVATION COMMISSION. Motion made and seconded to appoint Stephen D. Anderson, Esq., of the law firm of Anderson and Kreiger as Special Assistant Town Counsel for the purpose of providing legal services in environmental matters relating to with the Town's former railroad right-of-way property off Lafayette Street, at the site ofthe forrner "Lead Mills" property, so-called.

Motion made and seconded to refer to counsel the proposed EPA consent order received tonight and request a report next Wednesday, August 7, 1996. All in favor.

INSURANCE. Motion made and seconded to authorize Town Administrator Sasso to sign the annual renewal of the stop loss insurance contract with R E. Moulton. All in favor.

Motion made and seconded that the Board go into Executive Session to discuss strategy with respect to collective bargaining, votes may be taken, and if they are, votes will be released at a time deemed appropriate by counsel, not to resume in open session. On a polled vote, the Board voted as follows: Mr. Purdin, in favor; Mrs. St. Laurent, in favor; Mr. Cutting, in favor; and Mr. Conly. in favor.
