BOARD OF SELECTMEN
Minutes
March 13, 1996

Board met in Regular Session 7:30 p.m. in their Meeting Room in Abbot Hall

Motion made and seconded to accept the minutes of March 6, 1996 and March 7, 1996.

CROSBY'S MARKET/TOWN COUNSEL. Mary Ellen Walsh-Rogalski. Assistant Town Counsel Walsh-Rogalski presented four documents to the Board relative to the Massachusetts Capital Community Fund Loan to Crosby's Markets. These documents were Statement of Financial Interest, Commitment Letter, Grant Management Contract between the Town and the EOCD, and a Letter of Agreement between the Town and the attorney for EOCD for this project. Motion made and seconded to authorize Chairman McNulty to sign these documents. All in favor. Motion was made and seconded to appoint George A. Hewitt of the law firm Davis, Malm & D'Agostine as Assistant Town Counsel for the purpose of representing the Town in connection with this grant. All in favor. It was noted Mr. Hewitt's fees will be paid by Mr. Crosby, and Mr. Hewitt's exposure will be covered by his malpractice insurance.

Former Hawkes St. Cafe

LICENSE. Wine and Malt. Cancellation Hearing - Hawkes Street Cafe. Motion made and seconded to continue the cancellation hearing from March 6, 1996 on Hawkes Street Cafe. Ted Moore and Peter Capalbo, Manager of Record on the license, appeared before the Board. After discussion relative to potential buyers of this restaurant, it was moved and seconded to continue this hearing until April 10, 1996 at 7:35 p.m. All in favor.

LICENSE. All Alcoholic Beverage. Cancellation Hearing - Fortune Thai, Inc., d/b/a Erawan Restaurant. Motion made and seconded to continue this hearing to next week. All in favor.

LICENSE. Wine and Malt. Cancellation Hearing - Pleasant Street Cafe. Motion made and seconded to table the cancellation hearing of Pleasant Street Cafe. All in favor.

Common Victualler. II Porto. Osama Abulniaj and Kathleen Abulniaj appeared before the Board requesting a Common Victualler License for the II Porto, formerly Pleasant Street Cafe. Motion was made and seconded to table this request until 8:15 p.m. on March 20,1996 at which time their request for a transfer of the liquor license from Pleasant Street Cafe will also be held. Motion made and seconded to remove the cancellation hearing of the Pleasant Street Cafe from the table. All in favor. Motion made and seconded to continue the cancellation hearing to next week. All in favor.

ENTERTAINMENT LICENSE. Rio Grande Cafe. Motion made and seconded to approve the request of Mario A. Castallo, III, Assistant General Manager of the Rio Grande Cafe, for an entertainment license for Monday, April 22, 1996. The entertainment will be live acoustic Blues music. All in favor.

Selectmen's Room

PERMISSION. Abbot Hall. Motion made and seconded to approve the request of Meredith Paige Miles to use the Selectmen's Meeting Room on the afternoon of May 15, 1996, with the understanding there will be no food or beverage. All in favor.

SIGN. Motion made and seconded to approve the request of Jeanne E. Welch for a sign, "Hearing Impaired Child" be placed both at the Jersey Street end of Ramsdell Street and at the top of the hill on Abbot Street heading in the direction of Ramsdell under the supervision of the Surveyor of Highways. All in favor.

ENTERTAINMENT LICENSE. Michael's House Restaurant. Motion made and seconded to approve the request of John Crowley of Michael's House Restaurant for a one-day entertainment license for Sunday, March 17, 1996 for a three-piece band. All in favor.

PERMISSION. Road Race. Motion made and seconded to approve the request of the Gerry #5 Veteran Fireman Association, Inc. to hold a twenty-two mile bicycle race on Saturday, July 27, 1996 subject to approval of the Police Department. This race will proceed down West Shore Drive, right on Lafayette Street, left onto Maple Street, right onto Humphrey Street, through Swampscott, Lynn Shore Drive to the Coast Guard Station in Nahant, and back to Marblehead on the same route. All in favor.

HARBORMASTER. Mooring Permits. Notice from Harbormaster Warner Hazell was read reminding Mooring Permit holders who have not paid their 1996 fee are delinquent as of March first. They will have to pay a $20.00 late fee to have their permit processed. If payment is not received by April 1, 1996, their mooring equipment is subject to removal and a person from the Waiting List will be assigned to their location.

Paul Williams and Warner Hazell

HARBORS AND WATERS BOARD. Chairman Paul Williams of this Board along with Harbormaster Hazell appeared before the Board. A lengthy discussion was held concerning the enterprise fund, costs of maintaining waterfront properties, visions of improving harbor facilities. Board member Bill Pattison discussed repair to the seawall in front of the Transportation. Robbie Doyle, representing Friends of Marblehead Harbor, presented a written proposal from Gary Gregory encouraging a long-range capital plan as well as citing some short-term problems. Jack Attridge also appeared in support of this concept. Jay Michaud of the Harbors and Waters Board made a presentation on Marblehead Harbor improvements as they relate to the commercial fishermen.

Motion made and seconded that the Board go into Executive Session to discuss strategy with respect to a grievance and collective bargaining, votes may be taken, and if they are, votes will be released at a time deemed appropriate by Counsel, not to resume in open session. On a polled vote, the Board voted as follows: Mr. Purdin, in favor; Mr. Conly, in favor; Mrs. St. Laurent, in favor; Mr. Peck, in favor; and Mr. McNulty in favor.
