BOARD OF SELECTMEN
Minutes
February 12, 1997

Board met in Regular Session 7.30 p.m. in their Meeting Room in Abbot Hall

Present (constituting a quorum):

FIREWORKS. Motion made and seconded to authorize Chairman McNulty to sign the contract with Atlas Advanced Pyrotechnics, Inc. for the Fourth of July Fireworks. All in favor.

DRAIN CONSTRATCTION. A letter from Lt. Dave Millett of the Marblehead Police Department was read announcing, a meeting to be held at St. Stephen's United Methodist Church on Cornell Road on Tuesday, March 4, 1997 at 7:30 p.m. pertaining to the continuation of the drain construction project along Pleasant Street to Tent's Corner. The public is invited to attend.

RETIREMENT BOARD. Notice read announcing there will be a public meeting held on February I8, 1997 at 7:30 p.m. at the Mary Alley Building Conference Room pertaining to the requirement that the Retirement Board establish an early intervention plan. Attorney Thomas A. Hickey, III will be present to explain the law. The procedure to develop the early intervention plan will be discussed in detail as the final plan for the Town must be submitted to the State by March 15, 1997.

LICENSE. Wine and Malt. Cordials and Liqueurs Permit. A public hearing was held pertainhlg to the application of Ayman M. Noufal of Brick, Wood, n Fire, Inc. d b/a Il Moro for a Cordials and Liqueurs Permit on his Wine and Malt License. Mr. Noufal was present to speak in favor. There was no opposition. Motion made and seconded for approval. On a polled vote, the Board voted as follows: Mr. Cutting, in favor; Mr. Purdin, in favor; Mrs. St. Laurent, in favor, Mr. Conly, in favor; and Mr. McNulty, in favor. Permit was granted.

MINUTES. Motion made and seconded to approve the minutes of February, 1997. All in favor.

BELLS. Motion made and seconded to request that the church bells throughout Town as bell as those in Abbot Hall ring on Washington's Birthday, February, 1997 at the usual holiday hours -- from 7:30 a.m. to 8:00 a.m.; 12:00 noon to 12:30 p.m.; and from 6:00 p.m. to 6 30 p.m. All in favor

LICENSE. Amusement Devices. Jacob Marley's Restaurant. Motion made and seconded to approve the application for two Automatic Amusement Device Licenses for Jacob Marley's Restaurant --Magical Touch Il and Mega Touch. All in favor.

TRAFFIC & SAFETY. Motion made and seconded to approve the following for a thirty-day trial period: To rescind the two hour parking limits on Hawkes Street between Atlantic Avenue and Washington Street. To rescind two hour parking limits on Prospect Street between Washington and Barnard Street. To rescind the two hour parking limit on Commercial Street between Prospect Street and number 44 Commercial Street. To rescind the two hour parking limit on Central Street in its entirety. To rescind the two hour parking limit on Chestnut Street in its entirety. To rescind the two hour parking limit on Gregory in its entirety. That the one hour parking Iimits on Pleasant Street between Village Street and Bessom Street as well as between 11 Pleasant Street and Washington Street be increased to two hours. That the one hour parking limit on School Street be increajed to two hours. That the one hour parking limit on Front Street be increased to two hours. All in favor. Motion made and seconded to make the following, parking regulations for a thirty day trial period: Commercial Street -- on the Northeast side beginning at a point 20 feet from the intersection of Atlantic Avenue, for a distance of 26 feet in an easterly direction, create "No Parking This Side." (This will eliminate the one parking space on Commercial Street next to the Marblehead Toy Shop.) Commercial Street -- on the Southwest side beginning at forty-four feet from the southwest corner of Atlantic Avenue for a distance of forty-eight feet easterly to the driveway of No. 17 Commercial Street (This will create three parking spaces next to the Shipyard Galley immediately after the yellow curb.) All in favor. Motion made and seconded to ask Traffic & Safety to investigate the misuse of the cross hatching on Commercial Street outside the CVS Pharmacy. All in favor.

HOLOCAUST AWARENESS WEEK. Motion made and seconded to proclaim May 4,1997 to May 10, 1997 Holocaust Awareness Week. AII in favor.

PERMISSION. Road Race. Motion made and seconded to approve the request of William Zazynski of the YMCA to hold their I8th Annual "Ring Around the Neck Road Race" on Sunday, April 27, 1997 at 1:00 p.m. subject to Police Department approval. The five-mile course is as follows: Beginning at intersection of Washington Street and Atlantic Avenue proceeding South on Atlantic to East on Ocean Avenue. Veer right after causeway, left onto Harbor Avenue proceeding, to Ocean Avenue and back onto causeway. Make a right onto Atlantic Avenue to finish line at intersection of Washington Street and Atlantic Avenue. All in favor.

REVOLVING FUND ACCOUNTS. Motion made to continue for fiscal 1998 the revolving fund of the Historical Commission approved, recommended and authorized by Town Meeting for fiscal 1997. All in favor. Motion made to continue for fiscal 1998 the revolving fund of the Board of Health approved, recommended and authorized by Town Meeting for fiscal 1997. All in favor. Motion made to continue for fiscal1998 the revolving fund of the Council on Aging approved, recommended and authorized by Town Meeting for Fiscal 1997. All in favor. Motion made to continue for fiscal 1998 the revolving fund of the Animal Control Department approved, recommended, and autllorized by Town Meeting for fiscal 1997. All in favor.

Motion made and seconded to adjourn at 8:00 p.m. All in favor.
